The Nurtured Being Customer Terms & Conditions

Bookings & Payments

  • All sessions/classes must be booked in advance through the agreed scheduling platform or directly via email/phone.

  • Payments are required prior to the session, through the online booking portal/card device.

  • A package of sessions must be paid in full before commencing.

  • All sessions/classes are non-refundable and non-transferable

Refunds Policy

  • Refunds for packages or prepaid sessions are not available unless extenuating circumstances arise, such as medical reasons, which must be accompanied by a doctor’s note.

Personal Property

  • The instructor, the venue/studio or the business at which Pilates practice is partaken cannot be held responsible for any damage or loss to personal property whilst on the (company) premises.

Health & Safety

  • Clients must complete a health questionnaire before starting any Pilates sessions, including specific information regarding pregnancy or postpartum recovery, where relevant. Dependent on this questionnaire the instructor may request approval from my doctor before commencing Pilates.

  • All clients must complete a postural assessment/natal assessment before starting Pilates sessions/classes. Clients understand they may be advise to seek professional medical advice (e.g. physiotherapy/GP input) if a concern is highlighted in this assessment.

  • The, face-to-face postural and movement assessment, is mandatory before starting any sessions/classes with The Nurtured Being. When the instructor is completing the assessment they may need to see the area by requesting a small degree of undress, and that this will be explained at the time by the instructor. Following an examination and assessment, an explanation of the instructor’s findings and suggested Pilates aims will be communicated. At any time, clients are entitled to request a chaperone to be present during my assessment or sessions. The instructor may use tactile feedback, but verbal consent will be gained in advance. Clients will inform the instructor if they are uncomfortable with this.

  • No personal medical advice will be provided and the instructor will not be operating in a medical capacity.

  • Clients are responsible for ensuring they are in good health and fit to participate in the sessions and accept there are risks with any exercise including injury, abnormal blood pressure, fainting, irregular, fast or slow heart rhythm, heart attack, stroke or death. Clients agree to stop/communicate to my instructor if I feel fatigue/pain/discomfort.

  • The instructor should be informed of any medical conditions, including but not limited to pregnancy, postpartum issues, injuries, or surgeries.

  • Whilst completing Pilates in person any exercise complete will be observed and corrected, however, clients accept full responsibility for any injury that may occur if I choose to complete any Pilates exercises outside a session/class.

Pregnancy

  • All clients must inform the instructor in advance if they fall pregnant and will complete a maternity screening questionnaire and waiver before completing any further sessions/classes.

  • Ante and postnatal clients must understand the limitations of physical activity during this time and adhere to the instructor’s guidance for safe practice.

  • All exercises will be tailored to the individual’s stage of pregnancy or postpartum recovery, but clients are encouraged to communicate any discomfort immediately.

Cancellation Policy

  • Clients must provide at least 48 hours' notice for cancellations or rescheduling. Failure to do so may result in the full session fee being charged.

  • If the instructor needs to cancel a session, as much notice as possible will be provided, and the session will be rescheduled or refunded.

  • If any session is cancelled outside of 48 hours it can be re-arranged to take place within 7 days at no additional cost. If the session is not completed within 7 days, it will still be charged in full and forfeited.

Late Arrival to the Session

  • Sessions will start and end at the scheduled time. Late arrivals will result in a shorter session, but the full fee will still apply.

  • If the instructor is more than 15 minutes late on arrival to the session, the client will be entitled to a full session from the time that the trainer arrives (if convenient), or I can have the remaining time of the session added onto another session.

 

Confidentiality

  • Confidentially is not be expected where information has become generally available to the public and where information was available or known on a non-confidential basis before being disclosed under any agreement.

  • The instructor may discuss client classes anonymous for teaching purposes, in these cases the instructor will discus this in advance.

Code of Conduct

  • Clients are expected to conduct themselves respectfully in all sessions. The instructor reserves the right to terminate sessions if inappropriate behavior is displayed.

Data/Referral

  • The instructors may suggest referral to a medical specialty (e.g. physiotherapist/Orthotic Services). In these instances this will be communicated directly and written consent gained if the instructor feels it would be beneficial to communicate directly to any medical personnel on the client’s behalf. In these instances personal information will be shared with medical specialists directly.

  • Personal information will be shared in the event of medical emergencies.

Changes to the Services

  • The Nurtured Being has the right to change services which are necessary to comply with any applicable law or safety requirement.

Changes to Terms & Conditions

  • The Nurtured Being reserves the right to update these T&Cs as necessary. Clients will be informed of any significant changes in advance.

Circumstances beyond the control of either party

  • Neither party shall be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of that party. Such causes include, but are not limited too: power failure, internet service provider failure, acts of God, epidemic, pandemic, civil unrest, fire, floods, droughts, storms, earthquakes, collapse of buildings, explosion or accident, acts of terrorism, acts of war, governmental action, any law or any action taken by a government or public authority.

  • If failure/delay to provide services continues for a period of 90 days clients may terminate or cancel my sessions/classes/assessments and receive a full refund.
